The question of how to deal adequately with neo-Nazis and Holocaust deniers in democratic societies has been constantly on the agenda for 20 years. Whether it is the process against Ernst Zuendel 1988 in Canada, the so-called “Leucher Report” or nowadays another process against the revisionist David Irving in Vienna by mid February 2006, the examined legal questions are always the same. What differs is how the countries handle with them. Austria, with its “Prohibition Act”, possesses a specific legal situation not comparable to any other country in Europe. A thorough-going analysis of the legal questions concerning the measures against die-hard nazis and Holocaust deniers might teach us a lot about very timely questions dealing with political and religious extremists.
